O. , Case No. R-22$9 SUPPLEMENTAL DECISION AND CERTIFICATION OF REPRESENTATIVES March 3, 1941 On January 16, 1941, the National Labor Relations Board, herein called the Board, issued a Decision and Direction of Election in the above-entitled proceeding.' Pursuant to the Direction of Election, an election by secret ballot was conducted on February 4, 1941, under the direction and supervision of the Regional Director for the Eight- eenth Region (Minneapolis, Minnesota). On February 7, 1941, the Regional Director acting pursuant to Article III, Section 9, of National Labor'Relations Board Rules and Regulations-Series 2, as amended, issued and duly served upon the parties his Election Report. As to the balloting and its results, the Regional Director reported as follows : Total number eligible-------/-------------------------------- 409 Total number of ballots cast---------------------------------- 366 Total number of votes counted-------------------------------- 366 Total number of ballots cast for International Association of Machinists, Harmony Lodge No. 831 (A. O.)--------- 278 Total number of ballots cast for neither of the above organiza- tions ----------------------------------------------------- 7 Total number of blank ballots-------------------------------- 0 Total number of void ballots--------------------------------- 0 Total number of challenged ballots--------------------------- 0 On February 7, 1941, the I. A. M. filed Objections to the Election Report, alleging in substance that employees were permitted to wear campaign buttons bearing the words "For Higher Wages, Job Security, Vote C. I. 0." both in the plant and at the polling place, and that such acts had a "decided bearing on the results of the election." On Feb- 2 29 N. L. R. B. 40 30 N L R. B., No 9 56 LA PLANT-CHOATE MANUFACTURING CO. 57 ruary 17, 1941, the Regional Director issued a Report on Objections, copies of which were duly served on the parties, in which he reported that the afore-mentioned campaign buttons had been worn at work and in the polls both prior to and on the date of the election. The Board has fully considered the Election Report, the Objections, and the Report on Objections, and finds that the objections raise no sub- stantial and material issues with respect to the conduct of the ballot or the Election Report. The objections are hereby overruled. CERTIFICATION OF REPRESENTATIVES By virtue of and pursuant to the power vested in the National Labor Relations Board by Section 9 (c) of the National Labor Relations Act, 49 Stat. 449, and pursuant to Article III, Sections 8 and 9 of National Labor Relations Board Rules and Regulations-Series 2, as amended, IT Is HEREBY cElrrrFIED that United Farm Equipment Workers Or- ganizing Committee, Local 116, affiliated with the C. I. 0., has been designated and selected by a majority of the production, maintenance, and service employees of La Plant-Choate Manufacturing Co., Inc., Cedar Rapids, Iowa, excluding supervisory and clerical employees, engineering personnel, and dispatch clerks, as their representative for the purposes of collective bargaining, and that pursuant to the provi- sions of Section 9 (a) of the National Labor Relations Act, United Farm Equipment Workers Organizing Committee, Local 116, affiliated with the C. I.
