In a phone call on March 9, 2010, Marc S. Weiner, counsel for junior 1
party, Universite Laval, informed Ms. Yolunda Townes, a paralegal 2

specialist of the Board, that Laval would not be proceeding with the 1
interference. 2
The failure to proceed and file necessary papers is an abandonment of 3
the contest. An abandonment of the contest is construed as a request for 4
entry of adverse judgment. 37 C.F.R. § 41.127(b)(4). 5

ORDERED that judgment on priority as to the subject matter of 7
Count 1 (Paper 1, p. 3), is awarded against Application 11/698,121; 8
FURTHER ORDERED that claims 1-12 of Application 11/698,121, 9
corresponding to Count 1, are finally refused (35 U.S.C. § 135(a)); 10
FURTHER ORDERED that a copy of this judgment be made of 11
record in the files of Patent 6,284,242 and Application 11/698,121, and 12
FURTHER ORDERED that if there is any settlement agreement or 13
related documents which have not been filed, attention is directed to 14
35 U.S.C. § 135(c) and 37 CFR § 41.205. 15
