Case No. R-757 CERTIFICATION OF REPRESENTATIVES November 8, 1938 On September 23, 1938, the National Labor Relations Board, here- in called the Board, issued a Decision and Direction of Election in the above-entitled case. ' The Direction of Election directed that an election by secret ballot be conducted within fifteen (15) days from the date of the Direction among all the wage workers employed by Chautauqua Cabinet Co., Mayville, New York; Brocton Furniture Co., Brocton, New York; Herrick Furniture Co., Falconer, New York; John A. Kling (successor to Crandall Panel Co.), Brocton, New York; and'Frewsburg Furniture Co., Frewsburg, New York, who were employed by the Companies during the pay-roll period immediately preceding April 11, 1938, excluding clerical and super- visory employees, and those who had since quit or been discharged for cause, to determine whether or not they desired to be repre- sented by Organized Furniture Workers for the purposes of col- lective bargaining. Pursuant to this Decision and Direction of Election, an election by secret ballot was conducted on October 7, 1938, under the direction and supervision of the Regional Director for the Third Region (Buf- falo, New York). On October 10, 1938, the said Regional Director, acting pursuant to Article III, Section q, of National Labor Rela- tions Board Rules and Regulations-Series 1, as amended, issued and duly served upon the parties his Intermediate Report on the ballot. No objections or exceptions to the Intermediate Report have been filed by any of the parties. 18 N L. R. B 1228 9 N. L. R . Kling (successor to Crandall Panel Co.), Brocton, New York; and Frewsburg Furniture Co., Frewsburg, New York, excluding clerical and supervisory employees, as their representa- tive for the purposes of collective bargaining, and that, pursuant to Section 9 (a) of the National Labor Relations Act, Organized Fur- niture Workers is the exclusive representative of all such wage workers for the purposes of collective bargaining in respect to rates of pay, wages, hours of employment, and, other conditions of employment.
