I. O. Case No. R-1543 CERTIFICATION OF REPRESENTATIVES December 26, 1939 On October 27, 1939, the National Labor Relations Board, herein called the Board, issued a Decision and Direction of Election in the above-entitled proceedings.' On November 16, 1939, the Company filed a petition and motion to vacate the Direction of Election and to dismiss the petition for the investigation and certification of repre- sentatives. Thereafter, the Union filed objections to the petition and motion to vacate the Direction of Election and to dismiss the petition. On November 18, 1939, the Board denied the petition and motion to vacate the Direction of Election, and on November 22, 1939, issued an Amendment to Direction of Election.2 Pursuant to the Direction of Election, as amended, an election by secret ballot was conducted on December 4, 1939, under the direction and supervision of the Re- gional Director for the Seventh Region. On December 7, 1939, the said Regional Director, acting pursuant to Article III, Section 9, of National Labor Relations Board Rules and Regulations-Series 2, issued and duly served upon the parties his Election Report. No objections to the conduct of the ballot or to the Election Report have been filed by any of the parties. B., No. 80. 698 KELSEY HAVES WHEEL COMPANY 699 Total number of challenged ballots________________________ 2 Total number of blank ballots _____________________________ 11 Total number of void ballots______________________________ 3 By virtue of and pursuant to the power vested in the National Labor Relations Board by Section 9 (c) of the National Labor Rela- tions Act, 49 Stat. 449, and pursuant to Article III, Sections 8 and 9, of National Labor Relations Board Rules and Regulations-Series 2, IT IS HEREBY CERTIFIED that Local 174, International Union, United Automobile Workers of America, affiliated with the Congress of Industrial Organizations, has been designated by a majority of all production and maintenance employees of Kelsey Hayes Wheel Com- pany, a corporation, Detroit, Michigan, at its Detroit plants, includ- ing factory clerks, watchmen, tool and die makers, toolroom employees, powerhouse employees, and timekeepers, but excluding foremen, supervisory employees, and office clerical help, as their representative for the purposes of collective bargaining, and that, pursuant to the provisions of Section 9 (a) of the National Labor Relations Act, Local 174, International Union, United Automobile Workers of America, affiliated with the Congress of Industrial Or- ganizations, is the exclusive representative of all such employees for the purposes of collective bargaining in respect to rates of pay, wages, hours of employment, and other conditions of employment.
