Case No. R-1439 CERTIFICATION OF REPRESENTATIVES October 19, 1939 On September 2, 1939, the National Labor, Relations Board, issued a Decision and Direction of Election' in the above-entitled proceed- ing. The Direction of Election provided that an election by secret ballot be conducted within fifteen (15) days from the date of the Direction among the production and maintenance employees of Kan- sas Milling Company, Wichita, Kansas, who were employed during the pay-roll period next preceding the date of the Decision and Di- rection of Election, including employees who did not work during .such pay-roll period because they were ill or on vacation and em- ployees who were then or had since been temporarily laid off, but excluding executive and supervisory employees, office workers and chemists, and excluding also those who had since quit or been discharged for cause, to determine whether or not they desired to be represented by Flour, Feed, Seed, Cereal & Elevator Workers Union, No. 20991, A. F. of L., for the purposes of collective bargaining. Pursuant to the Direction of Election, an election by secret ballot was conducted on September 9, 1939, at Wichita, Kansas, under the direction and supervision of the Acting Regional Director for the Seventeenth Region (Kansas City, Missouri). On September 14, 1939, the Regional Director, acting pursuant to Article III, Section 9, of National Labor Relations Board Rules and Regulations-Series 2, issued and duly served upon the parties his Election Report. No Objections to the conduct of the ballot or the Election Report have been filed by any of the parties. F. of L. has been designated and selected by a majority of the production and maintenance employees of the Kansas Milling Company, excluding executive and su- pervisory employees, office workers, and chemists, as their repre- sentative for the purposes of collective bargaining, and that pursuant to the provisions of Section 9 (a) of the National Labor Relations Act, Flour, Feed, Seed, Cereal & Elevator Workers Union, No. 20991, A. F. of L., is the exclusive representative of all such employees for the purposes of collective bargaining in respect to rates of pay, wages, hours of employment, and other conditions of employment.
