The Decision grants Kaelin Motion 2 for judgment against all of 2 Maxwell’s involved claims based on a lack of written description and/or 3 enablement. Maxwell filed a responsive motion seeking to add a new claim 4 58 to cure the patentability defects raised in Kaelin Motion 2 but Maxwell 5 failed to demonstrate the patentability of its proposed claim. As Maxwell 6 provoked this interference and yet lacks any patentable claims, the Board 7 enters judgment on priority against Maxwell. Additionally, the Board’s 8 Decision on Motions granted Maxwell Motion 1 that Kaelin claim 8-11 be 9 held unpatentable. 10 Accordingly, it is: 11 ORDERED that judgment as to the subject matter of Count 1 12 (Paper 1 at 5) is entered against Maxwell, U.S. Application 10/472,595. 13 FURTHER ORDERED that Maxwell’s involved claims 1, 14 5-8, 14-15, 52 and 56 are FINALLY REFUSED, 35 U.S.C. § 135(a); 15 FURTHER ORDERED that Kaelin’s involved claims 8-11 are 16 CANCELLED, 35 U.S.C. § 135(a); 17 FURTHER ORDERED that the parties shall note the 18 requirements of 35 U.S.C. § 135(c) and Bd.
