Case No. R-1056 SUPPLEMENTAL DECISION AND ORDER February 6, 1940 On August 29, 1939, the National Labor Relations Board issued a Decision and Direction of Election in the above-entitled proceed- ing.' On September 16, October 16, and December 14, 1939, respec- tively, the Board issued an Amendment to Direction of Election,' Second Amendment to Direction of Election,' and Third Amend-' ment to Direction of Election.4 Pursuant to the Direction of Elec- tion, as amended, an election by secret ballot was conducted on Jaii- nary 12, 1940, under the direction and supervision of the Regional Director for the Second Region (New York City). On January 16, 1940, the Regional Director, acting pursuant to Article III, Section 9, of National Labor Relations Board Rules and Regulations-Series 2, issued and duly served upon all parties her Election Report. No objections to the conduct of the ballot or to the Election Report have been filed by any of the parties. The Regional Director reported the following results of the secret ballot : Total number eligible to vote----------------------------- 18 Total number of ballots cast----------------------------- 12 Total number of valid ballots ---------------------------- 12 Total number of votes in favor of Industrial Union of Marine and Shipbuilding Workers of America, Local #15, C. The petition for investigation and certification of representatives of employees of Jersey City Dry Docks Company will therefore be dismissed. ORDER By virtue of Section 9 (c) of the National Labor Relations Act, 49 Stat. 449 , and pursuant- to Article III, Sections 8 and 9, of Na- tional Labor Relations Board Rules and Regulations--Series 2, as amended, it is hereby ORDERED that the petition for investigation and certification of rep- sentatives of employees of Jersey City Dry Docks Company, Jersey City , New Jersey , filed by Industrial Union of Marine . and Ship- building Workers of America, Local No. 15 , be, and the same hereby is, dismissed.
