Oct. 24, 2012) Copy Citation New City, NY UNITED STATES OF AMERICA BEFORE THE NATIONAL LABOR RELATIONS BOARD JAWONIO, INC. Employer and LOCAL 888, UNITED FOOD & COMMERCIAL WORKERS Petitioner Case 02-RC-081336 DECISION AND CERTIFICATION OF RESULTS OF ELECTION The National Labor Relations Board has considered objections to an election held June 29, 2012, and the Administrative Law Judge's report recommending disposition of them. The election was conducted pursuant to a Stipulated Election Agreement. The tally of ballots shows 130 ballots cast for and 138 ballots cast against the Petitioner, with 1 void ballot and 2 challenged ballots, an insufficient number to affect the results. No exceptions have been filed to the Administrative Law Judge's report within the time provided. Accordingly, the Board adopts the Administrative Law Judge's findings and recommendations1, and finds that a certification of results of election should be issued. 1 The Administrative Law Judge recommended that the case be remanded to the Regional Director for the purpose of issuing the appropriate certification. However, there is no need for a remand because under Section 11472.3(b)(2) of the Board’s Case Handling Manual, Part Two, Representation Proceedings, the Board itself has the authority to issue such a certification. Accordingly, the Administrative Law Judge’s recommendation to remand the case is not adopted, and instead we shall issue the appropriate certification. 2 CERTIFICATION OF RESULTS OF ELECTION IT IS CERTIFIED that a majority of the valid ballots have not been cast for Local 888, United Food & Commercial Workers, and that it is not the exclusive collective-bargaining representative of these bargaining unit employees.
