James BergDownload PDFNational Labor Relations Board - Board DecisionsOct 17, 194136 N.L.R.B. 234 (N.L.R.B. 1941) Copy Citation In the Matter of JALMER BERG, AN INDIVIDUAL and LUMBER AND SAW- MILL WORKERS UNION, LOCAL #2667, AFFILIATED WITH THE' AMERICAN FEDERATION OF LABOR Case No. R-2813 CERTIFICATION OF REPRESENTATIVES October 17, 1941 On September 12, 1941, the National Labor Relations Board issued its Decision and Direction of Election in the .above-entitled pro- ceeding.1 Pursuant to the Direction of Election, an election by secret ballot was conducted on September 26, 1941, under the direction and supervision of the Regional Director for the Nineteenth Region (Seattle, Washington). On September 29, 1941, the Regional Di- rector, acting pursuant to Article III, Section 9, of National Labor Relations Board Rules and Regulations-Series 2, as amended, issued an Election Report, copies of which were duly served upon the parties. No objections to the conduct of the ballot or the Election Report have been filed by any of the parties. As to the balloting and the results thereof, the Regional Director reported as follows : Total on eligibility list-------------------------------------- 42 Votes cast for International Woodworkers of -America, Local No. 2-46, C. I. 0------------------------------------------ 11 Votes cast for Lumber and Sawmill Workers Union, Local #2667, A. F. of L------------------------------------------ 26 Total challenged ballots------------------------------------- 1 Total valid votes cast---------------------------------------- 37 Since the challenged ballot cannot affect the result of the election, we find it unnecessary to pass upon the challenge. By virtue of and pursuant to the power vested in the National Labor Relations Board by Section 9 (c) of the National Labor,Rela- tions Act, 49 Stat. 449, and pursuant to Article III, Sections 8 and 9, of National Labor Relations Board Rules and Regulations-Series 2, as amended, IT IS HEREBY CERTIFIED that Lumber and Sawmill Workers Union, Local #2667, affiliated with the American Federation of Labor, has 1 35 N. B., No. 44. 234 JALMER BERG, ET AL. 235 been designated and selected by a majority of the employees of Jalmer Berg, Bellingham, Washington, engaged in cutting, yarding, and loading, including hooktenders, and regular truck drivers, but exclud- ing supervisors and office employees, and operators of trucks for hire, as their representative for the purposes of collective bargaining, and that, pursuant to the provisions of Section 9 (a) of the National Labor Relations Act, Lumber and Sawmill Workers Union, Local #2667, affiliated with the American Federation of Labor, is the exclusive representative of all such employees for the purposes of collective bargaining in respect to rates of pay, wages, hours of employment, and other conditions of employment.
