Paper 10. The Request for Adverse Judgment is GRANTED. Interference No. 106,031 2 Accordingly, it is: ORDERED that judgment on priority as to Count 1, the sole count of the interference (Paper 1 at 4–5) be entered against Senior Party Pacesetter; FURTHER ORDERED that Claims 1–18 of Senior Party Pacesetter’s involved patent, US Patent No. 7,630,767, which correspond to Count 1 of the interference (Paper 1 at 4–5), are CANCELLED, 35 U.S.C. §135(a); 1 FURTHER ORDERED that a copy of this judgment shall be entered into the administrative record of (1) Junior Party Nanostim’s involved application, US Application No. 12/953,282 and (2) Senior Party Pacesetter’s involved patent, US Patent No. 7,630,767; FURTHER ORDERED that if there is any settlement agreement or related documents which have not been filed, attention is directed to 35 U.S.C. §135(c) and 37 C.F.R. §41.205; FURTHER ORDERED that a party seeking judicial review timely serve notice on the Director of the United States Patent and Trademark Office (37 C.F.R. §§ 90.1 and 104.2); and FURTHER ORDERED that attention is directed to Biogen Idec MA, Inc., v.
