F. of L., PETITIONER Case No. 2-RC-24,32.-Decided December 27,1950 DECISION AND ORDER Upon a petition duly filed under Section 9 (c) of the National Labor Relations Act, a hearing was held before I. L. Broadwin, hearing, officer. The hearing officer's rulings made at the hearing are free from prejudicial error and are hereby affirmed. Upon the entire record in this case, the Board finds : The Employer is a New Jersey corporation having its office and printing plant at Newark, New Jersey. It is engaged in the business of printing newspapers and circulars for firms which publish and dis- tribute them. The newspapers are the neighborhood, shopping guide type. They contain some advertising of nationally known products. and also advertising by public utility companies. They do not make use of any of the national news services. The circulars are used by retail stores. During a recent 12-month period the Employer purchased (a) paper, ink, mats, type, and other supplies aggregating over $41,000,. 75 percent of which came from points outside the State of New Jersey, and (b) machinery in excess of $2,500 in value, all of which came from outside the State. During the same period the. Employer received between $50,000 and $55,000 for the printing of 7 newspapers with a total circulation of 39,400, all within New Jersey. Also during the same period the Employer received $64,000 for the printing of cir- culars, 10 percent of which went out of State. While we do not find that the operations of the Employer are un- related to commerce, we find that, inasmuch as those operations do not in any respect meet our recently announced requirements for the. i As corrected at the hearing. 92 NLRB No. 154. 993 994 DECISIONS OF NATIONAL LABOR RELATIONS BOARD assertion of jurisdiction,2 it would not effectuate the policies of the Act to assert jurisdiction in this case. Accordingly, we shall dismiss the petition.
