In consideration of the need for administrative finality, surreply briefs are generally not permitted, “except by special leave of the Board.” Here, the Charging Party has not presented any circumstances warranting special leave. Moreover, having already filed a Reliant letter regarding the Kinder Morgan decision, the Respondents did not violate Section 102.46(h) of the Board’s Rules and Regulations when they responded to the Charging Party’s and General Counsel’s work preservation/right-to-control arguments with a discussion of Kinder Morgan in their reply brief.
