Case 17-CA-10772 12 March 1985 ORDER BY CHAIRMAN DOTSON AND MEMBERS HUNTER AND DENNIS On 13 September 1983 the National Labor Rela- tions Board issued a Decision and Order in this proceeding.' On 8 February 1985 the Board issued a Supplemental Decision on Reconsideration.2 On 7 March 1985 the United States Court of Appeals for the District of Columbia Circuit issued an Order in this proceeding. That Order instructed the Board "forthwith to reopen the record and return ' 267 NLRB 1187 2 273 NLRB 1856 (Member Dennis dissenting) 887 the matter to an administrative law judge to con- sider both (1) the Dudley statement on respond- ent's preference for employees with `a demonstrat- ed willingness to work in a nonunion environment,' and (2) the training manual as it bears on that crite- rion for selecting employees." The court also stated that "the further proceedings should be expedited so that the Board reaches and files with this court its final decision on the merits of the complaint on or before May 7, 1985." [Emphasis added.] The case having been remanded to the Board, IT IS ORDERED that the record in this case is re- opened and the matter returned to Administrative Law Judge Gerald A. Wacknov, who made the initial decision in this proceeding, for further proc- essing in accord with the court's Order of 7 March 1985.
