Interference, Re°;tramt, and Coercio b: anti-union statements; interrogation con- cerning union membership and activity; threats of discharge because of union organization; inquiry by respondent's attorney, during preparation of case, concerning union affiliation, which questioning was outside the scope of the issues of the pending proceeding and was made in the presence of representa- tives of management. Descrimination: charges.of, dismissed. Remedial Orders: cease and desist unfair labor practices. DECISION AND ORDER On November 10, 1942, the Trial Examiner issued his Intermediate Report in the above-entitled proceeding, finding that the respondent had engaged in and was engaging in certain unfair labor practices and recommending that it cease and desist therefrom and take certain affirmative action as set out in the copy' of the Intermediate Report attached hereto. Thereafter, the Union filed exceptions to the Inter- mediate Report and a brief in support of the exceptions. The respond- ent has not excepted to the findings and recommendations of the Trial Examiner. The Board has considered the rulings of the Trial Exam- iner at the hearing and finds that no prejudicial error was committed. The rulings are hereby affirmed. The Board has considered the Inter- mediate Report, the exceptions and the brief, and the entire record in the case, and hereby adopts the findings, conclusions, and recom- mendations of the Trial Examiner. ORDER Upon the entire record in the case, and pursuant to Section 10 (c) .of the National Labor Relations Act, the National Labor Relations Board hereby orders that the respondent, Industrial Life and Health 47 N L.
