I. O. Case No. R-3047 SECOND SUPPLEMENTAL DECISION AND ORDER April 7, 1942 On October 16, 1941, the National Labor Relations Board, herein called the' Board, issued its Decision and Direction of Election in- the above-entitled proceeding.' Pursuant to the Direction of Elec- tion, an election by secret ballot was conducted on November 6, 1941, under the direction and supervision of the Regional Director for the- Seventh Region (Detroit, Michigan). On March 12, 1942, the Board- issued a Supplemental Decision and Direction 2 in which, among other things, the,Board directed the Regional Director to open and count 13 challenged ballots. On March 23, 1941, pursuant to the Supplemental Decision and Direction, the Regional Director, acting pursuant to Article III, Section 9, of National Labor Relations Board Rules and Regulations-Series 2, as amended, issued and duly served upon the parties a Supplemental Election Report, setting forth that on March 20, 1942, the Regional Director opened the ballots, and that upon a count of said ballots, the results, of the election were- as follows : Total on eligibility list______________________________________ 162 Total ballots cast------ -------------------------------------- 136 Total ballots, challenges to which have been sustained -------- 4 Total blank ballots----------------------------------------- 1 Total void ballots-------------------------------------------- 0 Total valid votes cast_______________________________________ 131 Votes cast for United Furniture Workers of America, C I. O---- 63 Votes cast against United Furniture Workers of America, C. I 0--------------------------------------------------- 68 No objections to the counting of the ballots or to the Supplemental', Election Report have been filed by any of the parties. 136"N L R B 166 2 39 N L R B 750 40NLR.B.No36 244 IDEAL SEATING COMPANY 245 The results of the election show that no collective bargaining repre- sentative has been selected by a majority of the employees in the unit heretofore found to be appropriate for the purposes of collective .bargaining. The petition for investigation and certification of rep- resentatives of employees of Ideal Seating Company, Grand Rapids, Michigan, will therefore be dismissed. ORDER By virtue of Section 9 (c) of the National Labor Relations Act, 49 Stat. 449, and pursuant to Article III, Sections 8 and 9, o'f National Labor Relations Board Rules and Regulations-Series 2, as amended, - IT is HEREBY ORDERED that the petition for investigation and cer- tification of representatives of employees of Ideal Seating Company, Grand Rapids, Michigan, filed by United Furniture Workers of America, C.
