Pursuant to the Direction of Election, an election by secret ballot was conducted between June 14 and June 18, 1941 , by the Regional Director for the Sixteenth Region (Fort Worth, Texas ). On June 20 , 1941 , the Acting Regional Director, acting pursuant to Article III, Section 9, of National Labor Relations Board Rules and Regulations-Series 2, as amended , issued and duly served upon the parties his Election Report . No objections to the conduct of the ballot or to the Election Report have been filed by any of the parties. As to the balloting and its results , the Acting Regional Director reported as follows : Total number of eligibles____________________________________ 39 Total number of ballots counted______ ________________________ 37 Total number of votes for Inland Boatmen's Division of the National Maritime Union_____ _____________________________ 15 Total number of votes against the Inland Boatmen 's Division of the National Maritime Union______________________________ 22 Total number of void ballots_________________________________ 0 Total number of blank ballots ________________________________ 0 Total number of challenged ballots__________ _________________ 0 The results of the election show that no collective bargaining repre- sentative has been selected by a majority of the employees of the Company in the unit heretofore found 'to be appropriate for col- lective bargaining. ORDER By virtue of Section 9 (c) of the National Labor Relations Act, 49 Stat. 449, and pursuant to Article III, Sections 8 and 9, of Na- tional Labor Relations Board Rules and Regulations-Series 2, as amended, IT IS HEREBY ORDERED that the petition for investigation and certifi- cation of representatives of employees of Higman Towing Company, Orange, Texas, filed by Inland Boatmen's Division of National Mari- time Union, be, and it hereby is, dismissed.
