The Employer’s Request for Review of the Regional Director’s Decision and Direction of
Election is denied as it raises no substantial issues warranting review.1 The Employer’s request
to stay the election or impound the ballots is denied as moot.

1 In denying review of the Regional Director’s mail ballot determination, we agree with the
Regional Director that a mail ballot election was warranted under Factor 2 of Aspirus Keweenaw,
370 NLRB No. 45, slip op. at 1 (2020), because the 14-day testing-positivity rate in Wayne
County, where the Employer’s facility is located, was 5 percent or higher in the two weeks
preceding the Regional Director’s decision. Id., slip op. at 5. Accordingly, we find it
unnecessary to reach the Regional Director’s discussion of Factors 5 and 6.
