Case No. R-1176 AMENDMENT TO DIRECTION OF ELECTION April 7, 1939 On March 24, 1939, the National Labor Relations Board, herein called the Board, issued a Decision and Direction of Election in the above-entitled proceeding,' the election to be held within fifteen (15) days from the date of the Direction, under the direction and super- vision of the Regional Director for the Ninth Region (Cincinnati, Ohio). The Board, having been advised by the Regional Director for the Ninth Region that a longer period within which to hold the election is necessary, hereby amends the Direction of Election issued on March 24, 1939, by striking therefrom the words "within fifteen (15) days from the date of this Direction" and substituting therefor the words "within twenty (20) days from the date of this Direction." 12 N. [SAME TITLE] CERTIFICATION OF REPRESENTATIVES April °17,1939 On March 24, 1939, the National Labor Relations Board, herein called the Board, issued a Decision and Direction of Election in the above-entitled proceeding. On April 7, 1939, the Board issued an Amendment to Direction of Election. The Direction of Election, as amended, provided that an election by secret ballot be conducted within twenty (20) days of the Direction among all the production em- ployees of Heldman-Schild-Lasser, Inc., Cincinnati, Ohio, who were employed during the pay-roll period next preceding the date of the Direction, excluding foremen, assistant foremen, foreladies, assistant foreladies, employees having the right to hire and discharge, stock clerks, employees in the piece-goods department, final examiners, cut- ting-room boys, and those who have since quit or been discharged for cause, to determine whether they desired to be represented by Cin- 111 N. B. 1289. 125 126 HELDMAN-SCHILD-LASSER, INC. cinnati Joint Board of the Amalgamated Clothing Workers of Amer- ica, affiliated with the Congress of Industrial Organizations, or by United Garment Workers of America, affiliated with the American Federation of Labor, for the purposes of collective bargaining, or by neither. Pursuant to the Direction of Election, as amended, an election by secret ballot was conducted on April 11, 1939, at Cincinnati, Ohio, under the direction and supervision of the Regional Director for the Ninth Region (Cincinnati, Ohio). Full opportunity was accorded to all parties to this investigation to participate in the conduct of the secret ballot and to make challenges. On April 12, 1939, the Regional Director, acting pursuant to Article III, Section 9, of National Labor Relations Board Rules and Regulations-Series 1, as amended, issued and duly served upon the parties his Intermediate Report upon the secret ballot. No objections or exceptions have been filed by any of the parties. As to the balloting and its results, the Regional Director reported as follows : Total alleged eligible voters--------------------------------- 248 Total votes placed in the ballot box------------------------- 241 Total unchallenged votes for Amalgamated Clothing Workers of America----------------------------------------------- 154 Total unchallenged votes for United Garment Workers of America-------------------------------------------------- 74 Total unchallenged ballots for neither------------------------ 3 Total challenged ballots-- ----------------------------------- 9 Total blank ballots----------------------------------------- 0 Total void ballots- ------------------------------------------ 1 By virtue of and pursuant to the power vested in the National Labor Relations Board by Section 9 (c) of the National Labor Relations Act, 49 Stat. 449, and pursuant to Article III, Sections 8 and 9, of National Labor Relations Board Rules and Regulations-Series 1, as amended, IT Is HEREBY CERTIFIED that Cincinnati Joint Board of the Amal- gamated Clothing Workers of America, affiliated with the Congress of Industrial Organizations, has been selected by a majority of the production employees of Heldman-Schild-Lasser, Inc., Cincinnati, Ohio, excluding foremen, assistant foremen, foreladies, assistant fore- ladies, employees having the right to hire and discharge, stock clerks, shipping clerks, employees in the piece-goods department, final exam- iners, and cutting-room boys, as their representative for the purposes of collective bargaining, and that, pursuant to Section 9 (a) of the Act, Cincinnati Joint Board of the Amalgamated Clothing Workers of America, affiliated with the Congress of Industrial Organizations, is the exclusive representative of all such employees for the purposes of collective bargaining in respect to rates of pay, wages, hours of employment, and other conditions of employment. 12 N.
