DECISION AND CERTIFICATION OF REPRESENTATIVES STATEMENT OF THE CASE Upon petition duly filed by Local Union #2676, United Steel- workers of America, C. I. 0., herein called the Union, alleging that a question affecting commerce had arisen concerning the representation of employees of Hanna Iron Ore Company, Hibbing, Minnesota, herein called the Company, engaged at the Warren Mine near Hibbing, Minne- sota, in the mining and production of iron ore, the National Labor Relations Board provided for an appropriate hearing upon due notice. On July 31, 1942, before a hearing was held, the Company, the Union, and a Field Examiner for the National Labor Relations Board entered into a "STIPULATION FOR CERTIFICATION UPON CON- SENT ELECTION." Pursuant to the stipulation, an election by secret ballot was conducted on August 10, 1942, under the direction and supervision of the Regional Director for the Eighteenth Region (Minneapolis, Minnesota), among all employees of the Company at its Warren Mine, near Hibbing, Min- nesota, excluding foremen, assistant foremen, supervisors in charge of any class of labor, policemen; and salaried and clerical employees, to determine whether or not they desired -to be represented-by the Union for the purposes of collective bargaining. On August 11, 1942, the Regional Director issued and duly served upon the parties an Election 43 N. L . R. B, No 140. C 853 854 DECISIONS OF NATIONAL LABOR RELATIONS BOARD Report on the ballot. No objections to the conduct of the ballot or the Election Report have been filed by any of the parties. I. 0------------------------------------------- 14 Upon the basis of the stipulation, the Election Report, and the entire record in the case, the Board makes the following: FINDINGS OF FACT 1. A question affecting commerce has arisen concerning the -repre- sentation of employees 'at the Warren Mine of Hanna Iron Ore Com- pany, Hibbing, Minnesota, within the meaning of Section 9 (c) and Section 2 (6) and (7) of the National Labor Relations Act. 2. All employees of the Company at its Warren Mine, near Hibbing, Minnesota, excluding foremen, assistant foremen, supervisors in charge of any class of labor, policemen', and clerical and salaried em- ployees, constitute a unit appropriate' for the purposes of collective bargaining, within the meaning of Section 9 (b) of the Act. 3. Local Union #2676, United Steelworkers of America, affiliated with the Congress of Industrial Organizations, has been designated and selected by a majority of the employees in the above unit as their representative for the purposes of collective bargaining and is the ex- elusive representative of all employees in said unit, within the meaning of Section 9 (a) of the Act. CERTIFICATION OF REPRESENTATIVES By virtue of and pursuant to the power vested in the National Labor Relations Board by Section 9 (c), of the National Labor Relations Act, IT IS HEREBY CERTIFIED that Local Union #2676, United Steelworkers of America, affiliated with the Congress of Industrial Organizations, has been designated and selected by"a majority of all employees at the Warren Mine of Hanna 'Iron Ore Company, Hibbing, Minnesota, excluding,foremen, assistant foremen, supervisors in' charge of any class of labor, policemen, and clerical and salaried employees, as their representative for the purposes of collective bargaining, and that, pur- HANNA IRON ORE COMPANY 855 suant to Section 9 (a) of the Act , Local Union #2676 , United Steel-, workers of America, affilia tedwitlT the Congress of Industrial Organi- zations, is the exclusive representative of all such employees for the purposes of collective bargaining in respect to rates of pay, wages, hours of employment , and other conditions of employment.
