OF A., PETITIONER Case No. 01-RC-459.Decided December 16,1948 DECISION AND ORDER Upon a petition duly filed, a hearing was held before a hearing officer of the National Labor Relations Board. The hearing officer's rulings made at the hearing are free from prejudicial error and are hereby affirmed. Pursuant to the provisions of Section 3 (b) of the National Labor Relations Act, the Board has delegated its powers in connection with this case to a three-man panel consisting of the undersigned Board Members.* Upon the entire record in the case, the Board makes the following : FINDINGS OF FACT THE BUSINESS OF THE EMPLOYER The Employer is engaged at LaVerne, California, in the business of general engineering and building contracting, and the production and sale of rock, sand and transit mix concrete. During the year 1947, the Employer purchased materials and equipment worth more than $315,000, of which approximately 5 percent represented shipments from points outside the State of California. During the same period, all the Employer's products and services were sold within the State. While we do not find that the Employer' s operations are wholly unrelated to commerce, we are of the opinion that the relationship is remote and the operations are essentially local in character. The assertion of jurisdiction in this case would not, therefore, effectuate the policies of the Act.
