MAP,GOLIN & Co., INC. and INT'L LADIES HANDBAG, POCKETBOOK & NOVELTY WORKERS' UNION Case No. R-488 CERTIFICATION OF REPRESENTATIVES January 3, 1939 On November 14, 1938, the National Labor Relations Board issued a Decision and Direction of Election in the above-entitled case.' The Direction of Election directed that an election by secret ballot be conducted among all the production employees of H. Margolin & Co., Inc., Fitchburg, Massachusetts, employed at its Fitchburg plant dur- ing the pay-roll period next preceding the date of the Direction of Election, including all those whose work was directly connected with the production, receiving, or shipping of goods, exclusive of those engaged only in janitor or clerical work, those engaged in super- visory capacities, and those quitting or discharged for cause before the election;' to determine whether they desired to be represented by International Ladies Handbag, Pocketbook & Novelty Workers' Union or by Associated Handbag Workers of Fitchburg, for the purposes of collective bargaining, or by neither. Pursuant to the Direction, an election by secret ballot was conducted by the Regional Director for the First Region (Boston, Massachu- setts) on December 8, 1938. Full opportunity was afforded to all parties to this investigation to participate in the conduct of the ballot and to make challenges. On December 9, 1938, the Regional Director, acting pursuant to Article III, Section 9, of National Labor Rela- tions Board Rules and Regulations-Series 1, as amended, issued an Intermediate Report on the ballot which was duly served upon the Company on December 9, 1938, and upon the other parties on December 10, 1938. No objections or exceptions to the Intermediate Report have been filed. As to the results of the secret ballot, the Regional Director reported as follows: 19 N. L. R. B. 852. 10 N. L. R. Margolin & Co., Inc., at its Fitchburg, Massa- chusetts, plant, including all those whose work is directly connected with the production, receiving, or shipping of goods, exclusive of those engaged only in janitor or clerical work and those engaged in supervisory capacities, as their representative for ,the purposes of collective bargaining and that, pursuant to the provisions of Sec- tion 9 (a) of the National Labor Relations Act, Associated Hand- bag Workers of Fitchburg is the exclusive representative of all such employees for the purposes of collective bargaining in respect to rates of pay, wages, hours of employment, and other conditions- of employment.
