Pursuant thereto an election by secret ballot was conducted on March 26, 1941, under the direction and supervision of the Re- gional Director for the Second Region (New York City). On March 28, 1941, the Regional Director, acting pursuant to Article III. Section 9, of National Labor Relations Board Rules and Regula- tions-Series 2, as amended, issued and duly served upon the-parties her Election Report. No objections to the conduct of the ballot or the Election Report have been filed by any of the parties. As to the balloting and its results, the Regional Director reported as follows : - Total number eligible to vote-------------------------------- 28 Total number of ballots cast-------------------------------- 33 Total number of valid ballots------------------------------- 22 Total number of votes in favor of American Federation of Labor, Federal Labor Union #22532----------------------- 14 Total number of votes in favor of Tannery Workers, Local 27, C. I. 0----------------------------------------------- 8 Total number of votes in favor of neither union------------- 0 Total number of blank votes-------------------------------- 0 Total number of void ballots------------------------------- 0 Total number of challenged votes--------------------------- 11 The Regional Director stated in her Election Report that of the 11 votes challenged none should be counted on the ground that 9 consist of challenged ballots cast by ineligible voters 2 and the two remaining challenged votes could not affect the result of the election. The ruling of the Regional Director on these challenges is hereby affirmed. 1 29 N. L R. B., No. 170. 'These nine votes were challenged by an agent of the Board on the ground that thev were specifically excluded from the list of eligible voters by the Board ' s Direction of Election. 31 N. L. R. B., No. 29. 176 GREENE, TWEED & COMPANY 177 By virtue of and pursuant to the power vested in the National Labor Relations Board by Section 9 (c) of the National Labor Relations Act, 49 Stat. 449, and pursuant to Article III, Sections 8 and 9, of National Labor Relations Board Rules and Regulations- Series 2, as amended, IT Is ]HEREBY cERnnED that American Federation of Labor, Fed- eral Labor Union #22532 has been designated and selected by a majority of all production employees of Greene, Tweed & Co., New- ark, New Jersey, excluding executives, office and clerical workers, and foremen with the right to hire and discharge, as their repre- sentative for the purposes of collective bargaining, and that, pursu- ant to Section 9 (a) of the National Labor Relations Act, American Federation of Labor, Federal Labor Union #22532 is the exclusive representative of all such employees. for the purposes of collective bargaining in respect to rates of pay, wages, hours of employment, and other conditions of employment.
