L., PETITIONER Case No. 21-RC-472.-Decided November 03,1948 DECISION AND ORDER Upon a petition duly filed, a hearing was held before a hearing officer of the National Labor Relations Board. The hearing officer's rulings made at the hearing are free from prejudicial error and are hereby affirmed. Pursuant to the provisions of Section 3 (b) of the National Labor Relations Act, the Board has delegated its powers in connection with this case to a three-man panel consisting of the undersigned Board Members. * Upon the entire record in this case, the Board makes the following : FINDINGS OF FACT THE BUSINESS OF TILE EMPLOYER The Employer is engaged in the manufacture and sale of bakery products. It operates its only plant in Los Angeles, California. Dur- ing 1947, the Employer purchased raw materials and supplies valued at approximately $288,000, all of which were purchased directly from firms doing business within the State of California. Most of the firms from whom the Employer makes its principal purchases are engaged in interstate commerce. The total sales for the same period exceeded $420,000, and all sales were made to customers within the State of California. The Employer asserts that its operations do not affect commerce within the meaning of the Act. Accordingly, we shall dismiss the petition 2 ORDER IT is HEREBY ORDERED that the petition for investigation and certifica- tion of representatives of Virgil V. Voltz, an individual d/b/a Golden Crust Bakery, filed herein by Bakery and Confectionery Workers In- ternational Union of America, Local 37, A. F. L., be, and it hereby is, dismissed.
