March °26,1953 Supplemental Decision and Certification of Representatives On December 5, 1952, the Board issued a Decision and Direction of Elections in this proceeding." On December 8, 1952, the Employer filed a motion for reconsideration and a request for oral argument which was denied by a Board Order on December 24,1952. Pursuant to the Decision and Direction of Elections, on December 30, 1952, elections were conducted, under the direction and super- vision of the Regional Director for the Thirteenth Region, among cer- tain employees of the Employer to determine their desires with respect to representation for purposes of collective bargaining. The Decision established seven separate voting groups as follows: (1) All journeymen machinists, journeymen specialists, nonjourneymen spe. cialists, classes A and B, machinists' helpers, tool and die makers, and welders classes A, B, and C in department 80; (2) all tinsmiths and helpers; (3) all pipefitters classes, A, B, and C and pipefitters' helpers; (4) all powerhouse employees; (5) all blacksmiths and helpers; (6) all electricians classes A and B and helpers, excluding the electrical oiler; and (7) all production and maintenance employees, including em- ployees in departments 82 and 97, lubricators, and the electrical oiler, but excluding all employees in voting groups 1, 2, 3, 4, 5, and 6. The employees in groups 1, 2, 3, 4, and 5 voted on whether they desired to be represented by District No. 10, International Associa- tion of Machinists, AFL, herein called the IAM, by United Steel- 1101 NLRB 772. 103 NLRB No. 124. 1198 DECISIONS OF NATIONAL LABOR RELATIONS BOARD workers of America, CIO, herein called the Steelworkers, by Steel- workers Cooperative Union No. 18499, AFL, herein called Federal, or by none of these organizations. The employees in group 6 voted on whether they desired to be represented by Local 663, International Brotherhood of Electrical Workers AFL, herein called the IBEW, by the Steelworkers, by Federal, or by none of these organizations. The employees in group 7 voted on whether they desired to be repre- sented by the Steelworkers, by Federal, or by neither. Upon the conclusion of the elections, a tally of ballots was fur- nished each of the parties in accordance with the Board's Rules and Regulations. The tally shows that of approximately 55 eligible voters in group 1, 42 cast valid ballots for the IAM, 3 cast valid ballots for Federal, 4 cast valid ballots for the Steelworkers, and 1 ballot was cast against participating labor organizations. Of approximately 2 eligible voters in group 2, 1 cast a valid ballot for the IAM, and 1 for Federal. Of approximately 23 eligible voters in group 3, 18 cast valid ballots for the IAM, and 5 cast valid ballots for Federal. Of approximately 4 eligible voters in group 4, 3 cast valid ballots for Federal. Of approximately 2 eligible voters in group 5, 1 cast a valid ballot for the IAM, and 1 ballot was cast against participating labor organizations. Of approximately 33 eligible voters in group 6, 2 cast valid ballots for Federal, 29 cast valid ballots for the IBEW, and 2 cast valid ballots for the Steelworkers. Of approximately 715 eligible voters in group 7, 243 cast valid ballots for the Steelworkers, 418 cast valid ballots for Federal, there were 6 void ballots, and 3 ballots were cast against participating labor organizations. Thereafter, on January 5, 1953, the Employer filed timely objec- tions to the conduct of the elections and to conduct affecting the results of the elections. On January 12, 1953, the Regional Director issued and served upon the parties his report on objections recommending that the objections be overruled because they were directed to the Board's Decision and Direction of Elections and to the Board's Order denying the employer's motion for reconsideration rather than to any conduct in connection with the elections. On January 21, 1953, the Employer filed timely exceptions. We shall adopt the Regional Director's recommendations and dis- miss the Employer's objections and exceptions, in view of the fact that they do not raise any matters not previously considered by the Board before issuance of the Decision and Direction of Elections and the Order denying the motion for reconsideration. Because it appears from the tally of ballots that a majority of eligible voters in voting groups 1 and 3 have designated the IAM; in voting group 7, Federal ; and in voting group 6, the IBEW, as GLOBE STEEL TUBES CO . 1199 their respective bargaining representatives , we find that employees in the four voting groups, respectively, constitute four separate units appropriate for the purposes of collective bargaining within the mean- ing of Section 9 (b) of the Act. We shall certify the labor organiza- tion winning a majority of votes in each unit as the exclusive bar- gaining representative of all such employees. With respect to the employees in voting group 4, as they selected Federal, there has been no severance and they continue to remain in the production and maintenance unit now represented by Federal. With respect to the employees in voting groups 2 and 5, before the election directed in this proceeding the tinsmiths and helpers and blacksmiths and helpers were bargained for in a production and main- tenance unit representated by Federal. The IAM sought to sever the tinsmiths and helpers and blacksmiths and helpers from that overall unit, but was unsuccessful in that it did not win the elections. Ac- cordingly, there has been no severance, and the tinsmiths and helpers and blacksmiths and helpers continue to remain in the production and maintenance unit now represented by Federal. Certification of Representatives IT IS HEREBY CERTIFIED that (1) District No. 10, International Asso- ciation of Machinists, AFL; (2) Steelworkers Cooperative Union No. 18499, AFL; and (3) Local 663, International Brotherhood of Elec- trical Workers, AFL, respectively, have been designated and selected by a majority of the employees of Globe Steel Tubes Co., Milwaukee, Wisconsin, in the respective units herein found by the Board to be appropriate as their representatives for the purposes of collective bargaining and that pursuant to Section 9 (a) of the Act, the said organizations are, respectively, the exclusive representatives of all employees in such units, for the purposes of collective bargaining, with respect to rates of pay, wages, hours of employment, and other conditions of employment. FURTHER, IT IS HEREBY CERTIFIED that a majority of the valid ballots has not been cast for District No. 10, International Association of Machinists, AFL, which sought to represent all tinsmiths and helpers, all blacksmiths and helpers, and all powerhouse employees in separate units. Accordingly, there has been no severance and these groups therefore remain in the production and maintenance unit represented by Steelworkers Cooperative Union No. 18499, AFL.
