MARTIN COMPANY, EMPLOYER and INTER- NATIONAL ASSOCIATION OF MACHINISTS, PETITIONER Case No. 5-R-2910 SUPPLEMENTAL DECISION AND DIRECTION March 16, 1948 On August 21, 1947, pursuant to a Decision and Direction of Election 1 issued by the Board herein, an election by, secret ballot was conducted under the direction and supervision of the Regional Director for the Fifth Region (Baltimore, Maryland). Upon the conclusion of the election a Tally of Ballots was furnished the parties. The Tally shows that there were approximately 8542 eligible voters and that 6242 ballots were cast, of which 1916 were for the Petitioner, 2729 for International Union, United Automobile, Aircraft and Agricul- tural Implement Workers of America, CIO, herein called the Intervenor, 965 for neither, 15 void, and there were 617 challenged ballots. On August 25, 1947, the Employer filed timely objections to the conduct of the election alleging : (a) That the participating unions improperly interfered with the voting by displaying posters and marked ballots, by soliciting and threatening employees within the restricted poll area, and by mis- representing facts concerning the possibility of recall of laid-off employees ; (b) That the Board refused to permit the election to be held on pay-day when the maximum number of employees would have been present; (c) That, contrary to evidence introduced at the hearing, laid-off employees were permitted to vote although there was no expectancy of their return to work and in spite of the fact that the collective bar- 1 74 N. B., No 107. 755 781902-48-vol 76-49 756 DECISIONS OF NATIONAL LABOR RELATIONS BOARD gaining agreement forming the basis for their recall expired 4 days before the election; and (d) That Board agents displayed bias against the Employer during the course of the election. On January 30, 1948, the Regional Director issued and served upon the parties his Report on Objections and Challenges, recommending that the Employer's objections to the conduct of the election, be over- ruled, that the challenges to 508 ballots be overruled, that the challenges to 82 ballots be sustained, and that ruling be reserved on challenges to 27 ballots. Thereafter, the Petitioner, the Intervenor, and the Employer filed exceptions to the Regional Director's recommendations concerning certain challenges. The Employer did not except to the Regional Director's findings and recommendations concerning its objections to the conduct of the elec- tion. We shall accordingly adopt his findings and his recommendation to overrule the objections. The Petitioner excepted to the Regional Director's recommendation to overrule the Employer's challenges to the ballots of 333 of 344 voters whose names were on the recall list. These employees had been de- clared eligible to vote in the Board's Decision and Direction of Election issued on July 18, 1947. At the hearing the Petitioner had taken the position that employees on the recall list should be eligible to vote and, at the election, did not challenge any of these ballots. The Employer, in its exceptions, withdrew its challenges to these ballots. The Peti- tioner, however, now excepts to the Regional Director's recommenda- tion to open and count these ballots, on the ground that so much time has passed since the hearing that opening them at this time might mean that the outcome of the election would be determined by persons having no real expectation of reemployment. This contingency, even if true, is present in every election in which the employment relationship of employees who voted in the election is terminated after the election. We find no merit in the Petitioner's exception. Inasmuch as the Em- ployer, the challenging party, has now withdrawn its challenges, we shall adopt the Regional Director's recommendation to open and count the 333 challenged ballots of employees on the recall list, whose names appear on "Appendix A" attached hereto and made a part hereof. Their ballots are hereby declared valid. Inasmuch as none of the parties excepted to the Regional Director's recommendations to open and count the ballots of 122 employees whose names appear on "Appendix B" attached hereto and made a part hereof, we shall accept the recommendations of the Regional Director. Their ballots are hereby declared valid. GLENN L. MARTIN COMPANY 757 The parties did not except to the Regional Director's recommenda- tion to sustain the challenges to 77 of the ballots. Accordingly, we shall adopt the recommendation of the Regional Director to sustain the challenges to the ballots of the 77 persons whose names appear on "Appendix C" attached hereto and made a part hereof. Their ballots are hereby declared invalid. There remain for possible consideration challenges to 85 ballots. The parties excepted to the Regional Director's recommendations to overrule, sustain, or reserve ruling on the challenges to these ballots. Because a conclusive election may result from the opening and count- ing of the 455 challenged ballots discussed above, we need not at this time pass upon the Regional Director's rulings or order a hearing to resolve any disputed issue of fact raised by the exceptions to the Regional Director's findings and recommendations. DIRECTION By virtue of and pursuant to the power vested in the National Labor Relations Board by Section 9 (c) (1) of the National Labor Relations Act, as amended, and pursuant to Section 203.61 of National Labor Relations Board Rules and Regulations-Series 5, it is hereby DIRECTED that, as part of the investigation to ascertain representa- tives for the purposes of collective bargaining with Glenn L. Martin Company, Middle River, Maryland, the Regional Director for the Fifth Region shall, pursuant to the Rules and Regulations of the Board set forth above, within ten (10) days from the date of this Direction, open and count the ballots cast by the employees listed on "Appendix A" and "Appendix B," and thereafter prepare and serve upon the parties to this proceeding a Supplemental Tally of Ballots.
