Neel, of counsel to the Board. certification DECISION AND CERTIFICATION OF REPRESENTATIVES On February, 20, 1941, International Union, United Automobile Workers of America, affiliated with the Congress of Industrial Organi-• zations, herein called the Union, filed. with the Regional Director for the Thirteenth Region (Chicago, Illinois) a petition alleging that a question affecting commerce had arisen concerning the representation of employees of General Motors_ Sales Corporation, General Motors Parts Division, herein called the Company, engaged in, the manufac- ture of automobile parts at Chicago, Illinois, and requesting an investi- gation and certification of representatives pursuant to Section 9 (c) of the National Labor Relations Act, 49 Stat. 449, herein called the Act. On March 3, 1941, the National Labor Relations Board, herein called the Board, acting pursuant to Section 9 (c) of the Act and Article III, Section 3, of National Labor Relations Board Rules and Regulations- Series 2, as amended, ordered an investigation and authorized the Re- gional Director to conduct it and to provide for an appropriate hearing upon due notice. On February 26, 1941, the, Company, the Union, and a Field Examiner of the Board entered into a "Stipulation for Certifi- cation Upon Consent Election." I ' Pursuant to the Stipulation, an election by secret ballot was con- ducted on March 6, 1941, under the direction and supervision of the Regional Director among all employees in the parts stock department, 30 N. B., No. 117. 736 GENERAL MOTORS CORPORATION 737 including stock pickers, stock handlers, shipping checkers, stockroom clerks, receiving checkers, janitors, and maintenance men, excluding stock department manager, foremen, assistant foremen, stockroom supervisor, receiving supervisor, shipping supervisor, and all other persons working in a supervisory capacity, watchmen, office, and cleri- cal employees, to determine whether or not said employees desired to, be represented by the Union. On March 7, 1941, the Regional Director issued and duly served upon the parties his Election Report on the ballot. No objections to the conduct of the ballot or the Election Report have been filed by any of the parties. A question affecting commerce has arisen concerning the repre- sentation of employees of General Motors Sales Corporation, General Motors Parts Division, Chicago, Illinois, within the meaning of Sec- tion 9 (c) and Section 2 (6) and (7) of the National Labor Relations Act. 2. All employees in the parts stock department of General Motors Sales Corporation, General Motors Parts Division, Chicago, Illinois, including stock pickers, stock handlers, shipping checkers, stockroom clerks, receiving checkers, janitors, and maintenance men, excluding stock department manager, foremen, assistant foremen, stockroom supervisor, receiving supervisor, shipping supervisor, and all other persons working in a supervisory capacity, watchmen, office, and clerical employees, constitute a unit appropriate for the purposes of collective bargaining, within the meaning of Section 9 (b) of the National Labor Relations Act. 3. International Union, United Automobile Workers of America, affiliated with the Congress of Industrial Organizations, has been des- ignated and selected by a majority of the employees in the above unit as their representative for the purposes of collective bargaining and as the exclusive representative of all employees in the said unit, within the meaning of Section 9 (a) of the National Labor Relations Act. 738' DECISIONS OF- NATIONAL LABOR RELATIONS BOARD .CERTIFICATION OF REPRESENTATIVES- By virtue of-And pursuant to the power vested in the National Labor` Relations Board by. Corporation, General Motors Parts Division, Chicago, Illinois, includ-,, ing stock pickers, stock handlers, shipping checkers, stockroom clerks, receiving checkers, janitor's, and maintenance men, excluding stock department manager, foremen, assistant foremen, stockroom super- visor, receiving supervisor, shipping supervisor, and all other persons working in a supervisory capacity, watchmen, office, and clerical em- ployees, as their representative for the purposes of collective bargain- ing, and that, pursuant to the provisions of Section 9 '(a) of the Act, International Union, United Automobile Workers of America, affili- ated with- the Congress of Industrial Organizations, is the exclusive representative of all such employees, for the, purposes of collective bargaining in respect to rates of pay, wages, ' hours of employment, and other conditions of employment.
