OF L. - Case No. R-2222 SUPPLEMENTAL DECISION AND ORDER On'January 28,'1941, the National Labor Relations Board, herein called the Board, issued a 'Decision and Direction of Election, in the aibove-entitled proceeding. Pursuant to the Direction of Election, an election by secret ballot was conducted on February 27, 1941, under the direction and supervision of the Regional Director for the Thirteenth Region (Chicago, Illinois). On March 4, 1941, the Regional Director, acting pursuant to Article III, Section 9, of National Labor Relations Board Rules and Regulations-Series 2, as amended , issued and duly served upon the parties an Election Report on the ballot., As to the balloting and its results, the Regional Director reported as follows : Total on eligibility list_____________________________________ 329 Total ballots cast------------------------------------------ 267 Total ballots challenged------------------------------------ 3 Total blank ballots---------------------------------------- 0 Total void ballots---------------------------------------- 0 Total valid votes cast---------- ------------------------- 264 Votes cast for International Brotherhood of Electrical Workers, Local B-713, A. F. of L.________----------- 118 Votes cast against International Brotherhood of Electrical Workers, Local B-713, A. F. of L.----------------------- 146 On March 10, 1941, International Brotherhood of Electrical Work- ers, Local B-713, A. F. of L., herein called the Union, filed with the Regional Director, 'Objections to Certification of Election Re- sults. On March 24, 1941, the Regional Director issued a. Report on Objections to Election Report. Thereafter, the Union notified the Regional Director that it desired to withdraw its Objections. The request of the Union is hereby granted. 129 N L R. B., No. 121. 713 714 DECISIONS OF NATIONAL LABOR RELATIONS BOARD The results of the election show that no collective bargaining rep- sentative has been selected by a majority of the employees. The petition for investigation and certification of representatives of em- ployees of,Genco Mfg. Co., not Inc., a co-partnership consisting of Louis Gensburg; David Gensburg and Myer Gensburg, Chicago, Illinois, will therefore be dismissed. ORDER By virtue of Section 9 (c) of the National Labor Relations Act, 49 Stat. 449, and pursuant to Article III, Sections 8 and 9, of Na- tional Labor Relations Board Rules and Regulations-Series 2, as amended, IT IS HEREBY ORDERED that- the petition for investigation and certi- fication; of representatives of employees of Genco Mfg. Co., not Inc., a co-partnership consisting of Louis Gensburg, David Gensburg and Myer Gensburg, Chicago, Illinois, filed by International Brother- hood of Electrical Workers, Local B-713, A.
