JOHNSON, III, MEMBER LAUREN McFERRAN, MEMBER Dated, Washington, D.C., June 5, 2015. 1 In denying the Employer’s appeal, we note that the Regional Director’s determination was an exercise of administrative discretion, and we find that the Employer has not demonstrated that he abused that authority. Member Johnson notes the Employer’s concern over Johnnie’s Poultry interviews and specifically that such interviews be carried out in a “context free from employer hostility to union organization.” He notes that, for past interviews, those facts are what they are, and also that the Employer is free, for the purpose of future interviews, to add to the Johnnie’s Poultry requirements anything that it feels will make clear that it lacks hostility to the right to organize.
