JUDGMENT Request for Adverse Judgment 37 C.F.R. § 42.73(b) IPR2015-00224 Patent 6,259,381 B1 2 On December 11, 2015, Locata LBS LLC (“Patent Owner”) filed a Request for Adverse Judgment under 37 C.F.R. § 42.73(b). Paper 22 (“Request”). Under 37 C.F.R. § 42.73(b), “[a] party may request judgment against itself at any time during a proceeding.” Actions construed to be a request for adverse judgment include “[c]ancellation or disclaimer of a claim such that the party has no remaining claim in the trial.” 37 C.F.R. § 42.73(b)(2). In the Request, Patent Owner requests cancellation of all the challenged claims (claims 1–12) of U.S. Patent No. 6,259,381 B1 (“the ’381 patent”). Paper 22, 2. Patent Owner also requests that the Board enter adverse judgment against it. Id. Accordingly, we grant Patent Owner’s request to cancel claims 1–12 of the ’381 patent. We also grant Patent Owner’s request for entry of adverse judgment against itself in this proceeding. It is therefore ORDERED that Patent Owner’s Request for Adverse Judgment under 37 C.F.R. § 42.73(b) is granted; FURTHER ORDERED that judgment is entered herein against Patent Owner with respect to claims 1–12 of U.S. Patent No. 6,259,381 B1; and FURTHER ORDERED that this constitutes a final written decision under 35 U.S.C. § 318(a).
