ORDER TRANSFERRING PROCEEDING TO THE BOARD
and
NOTICE TO SHOW CAUSE
On January 12, 2016, the General Counsel filed with the Board a Motion to Transfer
Proceedings to the Board for Summary Judgment and Issuance of a Decision and Order
and a brief in support on the ground that there are no issues of material fact in dispute that
would warrant a hearing in this matter. On January 20, 2016, the Respondent filed a
response, agreeing that transfer of this proceeding to the Board is appropriate, but
asserting the complaint should be dismissed. Having duly considered the matter,
IT IS ORDERED that the above-entitled proceeding be transferred to and continued
before the Board in Washington, D.C., and that the hearing scheduled for February 10,
2016, be postponed indefinitely.
NOTICE IS GIVEN that cause be shown, in writing, filed with the Board in
Washington, D.C., on or before February 24, 2016 (with affidavit of service on the parties
to this proceeding), why the General Counsel’s motion should not be granted or why the
complaint should not be dismissed. Any briefs or statements in support of the motion shall
be filed by the same date.
