On May 20, 2009, Appellants filed an Appeal Brief to which the Examiner responded by filing an Examiner’s Answer on August 20, 2009. The Examiner’s Answer contained a new ground of rejection designated in accordance with MPEP § 1207.03. Appellants responded in compliance with 37 C.F.R. § 1.111 by filing a request that prosecution be reopened on October 19, 2009. Accordingly, it is ORDERED that application is remanded to the examiner to reopen prosecution.
