ORDER REMANDING APPEAL TO EXAMINER
This application was electronically received by the Board of Patent
Appeals and Interferences on May 24, 2010. A Docketing Notice was
mailed on June 8, 2010. Upon review of the application, it has been
determined that a remand to the Examiner is necessary to consider the
following issue.

RESPONSE PERIOD PENDING
In response to the April 14, 2008, Reply Brief, a Supplemental
Examiner’s Answer was mailed in this application on May 21, 2010. In
accordance with 37 CFR § 41.43(b) appellant may file another reply brief
within two months of a supplemental examiner’s answer. The two-month
period for response in this application has not expired. Thus, the application
is not ready for docketing as an appeal.
CONCLUSION
Accordingly, it is ORDERED that the application is remanded to the
Examiner:
1) for expiration of the two-month response period following the May
21, 2010, Supplemental Examiner’s Answer, as indicated above; and
2) for such further action as may be appropriate.
