On June 6, 2011, Appellant concurrently filed a request for oral hearing, a request for continued examination and notice of appeal and a petition under 37 C.F.R. § 1.182. On June 21, 2011, a Decision on Petition was mailed which dismissed the petition as moot. In accordance with that petition decision and MPEP § 706.07, the RCE will be treated as a request to withdraw the appeal and to reopen prosecution before the examiner.
