DECISION ON APPEAL This is an appeal1 under 35 U.S.C. § 134(a) involving claims to an antimicrobial adhesive sheet. The Patent Examiner rejected the claims as obvious. We have jurisdiction under 35 U.S.C. § 6(b). We affirm. 1 Appellants identify the Real Party in Interest as NITTO DENKO CORPORATION. (See App. Br. 2.) Appeal 2012-003348 Application 10/962,622 2 Claims 1-4 and 6-11 are on appeal. Independent claim 1 is representative and is reproduced in the “Claims Appendix” of Appellants’ Brief (App. Br. 15-16). The Examiner rejected the claims as follows: • claims 1-4 and 6-9 under 35 U.S.C. § 103(a) as unpatentable over Delgado2 and Otsu;3 and • claim 10 under 35 U.S.C. § 103(a) as unpatentable over Delgado, Otsu, and Watanabe;4 and • claim 11 under 35 U.S.C. § 103(a) as unpatentable over Delgado, Otsu, and Saeke.5 Upon consideration of the evidence on this record and each of Appellants’ contentions, we find that the preponderance of evidence on this record supports the Examiner’s conclusions that the subject matter of Appellants’ independent claim 1 is unpatentable over the combination of Delgado and Otsu. Appellants do not raise additional arguments regarding the rejections of claims 2-4 and 6-11. (See App. Br. 13.)
