Cases 15-CA-3700, 15-CA-3700-2, and 15-CB-1041 August 29, 1972 SUPPLEMENTAL DECISION AND ORDER On October 31, 1970, the National Labor Relations Board issued a Decision and Order (186 NLRB No. 40) reversing the Trial Examiner's Decision attached thereto and dismissing the complaint. On June 9, 1972, the United States Court of Appeals for the Fifth Circuit issued an opinion (462 F.2d 8) granting the Charging Party's petition for review, vacating the Board's Decision and Order, 1113 and remanding the proceeding for entry of an order consistent with the Trial Examiner's Decision. In accordance with the court's opinion, the Board has decided to affirm the Trial Examiner's rulings, finding and conclusions, and to adopt his recom- mended Order. ORDER Pursuant to Section 10(c) of the National Labor Relations Act, as amended , the National Labor Relations Board adopts as its Order the recommend- ed Order of the Trial Examiner and hereby orders that Everett Construction Company, Inc., and Gilco Construction Company, their officers, agents , succes- sors , and assigns , and Local Union No. 198 , United Association of Journeymen and Apprentices of the Plumbing and Pipe Fitting Industry of the United States and Canada , AFL-CIO, its officers , agents, and representatives, shall take the action set forth in the Trial Examiner's recommended Order. 198 NLRB No. 159 Copy with citationCopy as parenthetical citation
