Case No. R-1941 Investigation and Certification of Representatives : run-off election directed. SECOND SUPPLEMENTAL DECISION AND SECOND DIRECTION OF ELECTION January 09, 1941 On October 23, 1940, the National Labor Relations Board, herein called the Board, issued a Supplemental Decision and Direction in the above-entitled proceeding.' Pursuant thereto, the Regional Di- rector for the Sixth Region (Pittsburgh, Pennsylvania) opened and counted the four ballots challenged in the election conducted by the Board on August 31, 1940, and issued and duly served upon the parties a Supplemental Election Report. As to the results of the balloting, the Regional Director reported as follows : Total on eligibility list____________________________________ 210 Total ballots cast__________________________________________ 209 Total blank ballots ------------------- ---------------------- 0 Total void ballots__________________________________________ 0 Total valid ballots cast_____________________________________ 209 Votes for International Fur and Leather Workers' Union,' Af- filiated with the 0. I. 0___________________________________ 103 Votes for Tannery Workers' Union__________________________ 104 Votes cast for neither______________________________________ 2 No objections to the conduct of the ballot or to the Supplemental Election Report have been filed by any of the parties. On Novem- ber 15, 1940, ' Tannery Workers' Union requested that the Board should not hold a run-off election. On November 22, 1940, the Inter- national filed a request for a run-off election. Although neither of the competing labor organizations received a majority of the votes cast, the results of the election show that a 127 N L R B. 1080. 29 N. L. R. B., No. 50. 272 ELK TANNING COMPANY 273 substantial majority of the employees desire collective bargaining through an exclusive representative. Accordingly, the Board will direct a run-off election in which the eligible employees will be given .an opportunity to decide whether they desire to be represented by International Fur and Leather Workers' Union or by Tannery Work- ers' Union for the purposes of collective bargaining. SECOND DIRECTION OF ELECTION By virtue of and pursuant to the power vested in the National Labor Relations Board by Section 9 (c) of the National Labor Re- lations Act, 49 Stat. 449, and pursuaneto Article III, Sections 8 and 9, of National Labor Relations Board Rules and Regulations-Series 2, as amended, it is hereby DIRECTED that, as part of the investigation authorized by the Board to determine representatives for the purposes of collective bargain- ing with Elk Tanning Company, Ridgeway, Pennsylvania, an elec- tion by secret ballot shall be conducted as early as possible, but not later than thirty (30) days from the date of this Second Direction of Election, under the direction and supervision of the Regional Director for the Sixth Region, acting in this matter as agent for the National Labor Relations Board and subject to Article III, Sec- tion 9, of said Rules and Regulations, among the employees' de- scribed in the Direction of Election issued August 19, 1940, but excluding those who have since quit or been discharged for cause, to determine whether they desire to be represented by International Fur and Leather Workers' Union, affiliated with the Congress of; Industrial Orbanizations, or by Tannery Workers' Union, for the purposes of collective bargaining.
