Electrical Utilities Co.Download PDFNational Labor Relations Board - Board DecisionsMar 19, 194560 N.L.R.B. 1340 (N.L.R.B. 1945) Copy Citation In the Matter Of ELECTRICAL UTILITIES COMPANY and DISTRICT 50, UNITED MINE WORKERS OF AMERICA Case No. 13-R-0237 SUPPLEMENTAL DECISION AND SECOND DIRECTION OF ELECTION March 19, 1945 On April 7,1944, pursuant to the Decision and Direction of Election issued by the Board on March 13, 1944,1 and Amendment to Direction of Election issued on March 31, 1944,2 an election by secret ballot was conducted under the direction and supervision of the Regional Director for the Thirteenth Region (Chicago, Illinois). On April 10, 1944, District 50, United Mine Workers of America, herein called District 50, filed Objections to the election. On July 18, 1944, after a hearing on these Objections was held pursuant to the Board's Order of May 10, 1944, the Board issued a Decision and Order Setting Aside,Elec- tion,3 in which District 50's Objections were sustained and the election was set aside. It was further provided that a new election would be directed at such time as the Regional Director advised to be appropriate. The Regional Director having on March fi, 1945, advised the Board that the time is now appropriate, we shall direct that a second election by secret ballot be conducted among the employees in the unit here- tofore found appropriate. Those eligible to vote shall be all em- ployees in the appropriate unit who were employed during the pay- roll period immediately preceding the date of our Second Direction of Election herein, subject to the limitations and additions set forth in the Direction.4 SECOND DIRECTION OF ELECTION By virtue of and pursuant to the power vested in the National Labor Relations Board, by Section 9 (c) of the National Labor Relations 1 55 N. B., No. 232. 1340 ELECTRICAI4 UTILITIES COMPANY 1341 Act, and pursuant to Article III, Section 9, of National Labor Rela- tions Board Rules and Regulations-Series 3, as amended, it is hereby DIRECTED that, as part of the investigation to ascertain representa- tives for the purposes of collective bargaining with Electrical Util- ities Company, LaSalle, Illinois, a second election by secret ballot shall be conducted as early as possible, but not later than sixty (60) days from the date of this Second Direction of Election, under the direction and supervision of the Regional Director for the Thirteenth Region, acting in this matter as agent for the National Labor Rela- tions Board,, and subject to Article III, Sections 10 and 11, of said Rules and Regulations, among the employees in the unit heretofore found appropriate in Section IV of our Decision and Direction of Election, issued on March 13, 1944, who were employed during the pay-roll period immediately preceding the date of this Second Direc- tion of Election, including employees who did not work during said pay-roll period because they were ill or on vacation or temporarily laid off, and including employees in the armed forces of the United States who present themselves in person at the polls, but excluding any who have since quit or been discharged for cause, and have not been rehired or reinstated prior to the date of the second election, to determine whether they desire to be represented by Electrical Util- ities Workers, Local Union No. 12765, District 50, United Mine Work- ers of America, or by Local B-321, International Brotherhood of Electrical Workers, affiliated with the American Federation of Labor; or by neither.
