Employer and TEAMSTERS LOCAL 705 Petitioner Case 13-RC-135503 DECISION AND CERTIFICATION OF REPRESENTATIVE The National Labor Relations Board has considered objections to a secret-ballot election held October 8, 2014, and the Hearing Officer's report recommending disposition of them. The election was conducted pursuant to a Stipulated Election Agreement. The tally of ballots shows 144 ballots cast for the Petitioner, and 56 ballots cast against the participating labor organization. There was 1 void ballot and 3 challenged ballots, an insufficient number to affect the results. No exceptions have been filed to the Hearing Officer's report within the time provided. Accordingly, the Board adopts the Hearing Officer's findings and recommendations, and finds that a certification of representative should be issued.1 1 The Hearing Officer recommended overruling the Employer’s objections in their entirety. 2 CERTIFICATION OF REPRESENTATIVE IT IS CERTIFIED that a majority of the valid ballots have been cast for Teamsters Local 705 and that it is the exclusive collective-bargaining representative of the employees in the following appropriate unit: All full-time and regular part-time shipper/packers and pharmacy technicians employed by the Employer at its operation currently located at 5th Avenue and Roosevelt Road, Building 37 NW, Hines, IL; but excluding managers, office clerical employees and guards, professional employees and supervisors as defined in the Act.
