On August 23, 1939, the National Labor Relations Board issued a Decision and. Direction of Election in the above-entitled proceeding.' The Direction of Election provided that an election by secret ballot be conducted within ten (10) days from the date of the Direction among the employees of Dictaphone Corporation, New York City, in the service and repair department of its New York sales and service branch whose names appear on its pay roll immediately preceding the. Direction of Election, including employees who did not. work during such pay-roll period because they were ill or on vacation; and employees who were then or had since been temporarily laid off, but excluding the manager, assistant manager, telephone operator, and those who had since quit or been discharged for cause, to determine whether or not they desire to be represented by Local 1237, United Electrical, Radio & Machine Workers of America, C. I. 0., for the purposes of collective bargaining. Pursuant to the Direction of Election, an election by secret ballot was conducted on September 1, 1939, under the direction and super- vision of the Regional Director for the Second Region (New York City). Full opportunity was afforded to all parties to this investi- gation to participate in the conduct of the secret ballot and to make challenges. On September 6, 1939, the Regional Director, acting pursuant to Article III, Section 9, of National Labor Relations Board Rules and Regulations-Series 2, issued and duly served upon the parties her Election Report. I. 0., has been designated by a majority of the employees of Dictaphone Corporation, New York City, in the service and repair department of its New York sales and service branch, excluding the manager, assistant manager, and tele- phone operator, as their representative for the purposes of collective bargaining, and that, pursuant to Section 9 (a) of the National Labor Relations Act, Local 1237, United Electrical, Radio & Machine Work- ers of America, C. I. 0., is the exclusive representative of all such em- ployees for the purposes of collective bargaining in.respect to rates of pay, wages, hours of employment, and other conditions of em- ployment.
