JUDGMENT UNDER 37 CFR § 1.662 On April 27, 2000, Party Perucho et al. filed a document under 37 CFR § 1.662 requesting judgment in their favor as to the Interference No. 103,859 - 2 - subject matter of the interference count in Interference 103,510 (Paper No. 45). The document includes letters by each of Party De La Chapelle et al. and Party Thibodeau et al. requesting adverse judgment against themselves. Accordingly, judgment as to the sole count in issue is entered in favor of Party Perucho et al. Party Manuel Perucho, Miguel A. Peinado, Yurij Ionov, Sergei Malkhosyan, Michael McClelland and John Welsh (Perucho et al.) are entitled to a patent on the subject matter covered by claims 32-54 of Application No. 08/579,445, which correspond to the interference count. Party Albert De La Chapelle, Bert Vogelstein and Kenneth W. Kinzler (De La Chapelle et al.) are not entitled to a patent on the subject matter covered by claims 14-18, 23, 25 and 28-51 of Application No. 08/452,536, which correspond to the interference count. Interference No. 103,859 - 3 - Party Steven N. Thibodeau and Gary D. Bren (Thibodeau et al.) are not entitled to a patent on the subject matter covered by claims 1-14 of Application No. 08/455,637, now U.S. Patent No. 5,578,450, granted November 26, 1996, which correspond to the interference count.
