JUDGMENT PURSUANT TO 37 CFR § 1.662
Miyake has filed a paper requesting adverse judgment under
37 CFR § 1.662 (Paper 20).
Upon consideration of the record of the interference, it is
ORDERED that judgment as to Count 1, the sole count in
the interference, is awarded against senior party HIDEO MIYAKE
and IKUO KAWAUCHI;

FURTHER ORDERED that senior party, HIDEO MIYAKE and
IKUO KAWAUCHI, is not entitled to a patent containing claim 21
of application 09/993,634, which corresponds to Count 1; and
FURTHER ORDERED that a copy of this decision be given
a paper number and be entered in the administrative records of
Van Damme’s 6,153,353 patent and Miyake’s 09/993,634
application.
