The Intervenor’s Request for Review of the Regional Director’s Supplemental
Decision Regarding Intervenor’s Objections to Conduct of Election is denied as it raises
no substantial issues warranting review.1 Accordingly, this case is remanded to the
Regional Director for issuance of an appropriate Certification of Representative.

1 Member Hayes agrees that the Intervenor has failed to raise any substantial issues warranting
review in the specific circumstances of this case. Regarding the Intervenor’s specific allegation that the
Petitioner engaged in objectionable surveillance based on one employee supporter independently collecting
the ballot of another, he expresses no view concerning whether a third party’s handling of employees’ mail
ballots could be grounds for granting review or setting aside an election in different circumstances.
Member Becker is recused and did not participate in the consideration of this case.
