Decision and Direction of election, and its request to stay the election scheduled for March 24,
2017, is denied.1

This case involves the Board’s Final Rule on representation-case procedures, with which Acting Chairman
Miscimarra disagrees for the reasons expressed in his dissenting views in the Final Rule. 79 Fed. Reg. 74308, at
74430-74460 (December 15, 2014) (dissenting views of Members Miscimarra and Johnson). In this case, Acting
Chairman Miscimarra agrees with the denial of the Intervenor’s request for expedited review and to stay the
election, without prejudice to the Board’s consideration of the Intervenor’s pending Request for Review.
