Employer and Case 20-RC-18224 NATIONAL UNION OF HEALTHCARE WORKERS Petitioner DECISION AND CERTIFICATION OF REPRESENTATIVE The National Labor Relations Board has considered objections to an election held April 23, 2010, and the Acting Regional Director's report recommending disposition of them. The election was conducted pursuant to a Stipulated Election Agreement. The tally of ballots shows 23 ballots cast for the Petitioner, 16 ballots cast for the Intervenor,' 1 ballot cast against the participating labor organizations and 1 challenged ballot, an insufficient number to affect the results. No exceptions have been filed to the Acting Regional Director's report within the time provided. Accordingly, the Board adopts the Acting Regional Director's findings and 2recommendations, and finds that a certification of representative should be issued. SEIU-UHW (Service Employees International Union, United Healthcare Workers-West). 2 The Regional Director, on September 15, 2010, issued an Erraturn in which he recommended that a Certification of Representative issue. CERTIFICATION OF REPRESENTATIVE IT IS CERTIFIED that a majority of the valid ballots have been cast for National Union of Healthcare Workers and that it is the exclusive collective-bargaining representative of the employees in the following appropriate unit: All full-time and regular part-time Certified Nursing Assistants, Nursing Assistants, Cooks, Relief Cooks, Kitchen Helpers, Housekeepers, Laundry Workers, and Maintenance employees employed by the Employer and performing work at its facility located at 5767 Mission Street, San Francisco, California; excluding all office clerical and professional employees, guards, and supervisors as defined in the National Labor Relation Act.
