Apr. 19, 2017) Copy Citation UNITED STATES OF AMERICA BEFORE THE NATIONAL LABOR RELATIONS BOARD COMCAST OF FLORIDA/GEORGIA/ILLINOIS/ MICHIGAN, LLC Employer and Case 13-RD-128244 Stipulated INTERNATIONAL BROTHERHOOD OF ELECTRICAL WORKERS, LOCAL UNION 21, AFL-CIO Union and NIKOLAI OPALCHENSKI, AN INDIVIDUAL Petitioner DECISION AND CERTIFICATION OF REPRESENTATIVE The National Labor Relations Board has considered objections to an election held September 17, 2015, and the Acting Regional Director's report recommending disposition of them.1 The election was conducted pursuant to a Stipulated Election Agreement. The tally of ballots shows 34 ballots cast for the Union, and 31 ballots cast against the Union. There were 0 void ballots and 1 challenged ballot, which was an insufficient number to affect the results of the election. No exceptions have been filed to the Acting Regional Director's report within the time provided. Accordingly, the Board adopts the Acting Regional Director's findings and recommendations, and finds that a Certification of Representative should be issued.2 1 The Acting Regional Director recommended that Petitioner’s objections be overruled. 2 In his conclusion, the Acting Regional Director inadvertently stated that a “Certification of Results” should issue. However, given that a majority of the ballots were cast for the Union in the election, a “Certification of Representative” should issue. 2 CERTIFICATION OF REPRESENTATIVE IT IS CERTIFIED that a majority of the valid ballots have been cast for International Brotherhood of Electrical Workers, Local Union 21, AFL-CIO and that it is the exclusive collective-bargaining representative of the employees in the following appropriate unit: All full time and regular part time Installers, Converter Test/Repair Personnel, Bench Test Personnel, Service Technicians, Line Technicians and Electronic Technicians employed by the Employer at its location currently located at 4445 W Cortland Street, Chicago, IL; but excluding all other employees, all salaried employees, confidential employees, warehouse employees, dispatchers, customer service employees, QC Inspectors, engineers, commissioned sales employees, L/O Programming employees, employees in Human Resources and Payroll Departments, office clerical employees and guards, professional employees and supervisors as defined in the Act.
