DECISION N AND CERTIFICATION OYREPRESENTATIVES STATEMENT OF THE CASE Upon petition duly filed by Steel Workers Organizing Committee, heiem called the Union, alleging that a question affecting commerce has arisen concerning the representation of employees of Columbia Steel Company, herein' called the Company, engaged in the manufac- ture and sale of steel, steel products, and byproduct coke at plants located in Utah 'and California, the National Labor Relations Board provided for an appropriate hearing upon due notice On April 29, 1942, before a hearing was held, the Company, the Union, and the Regional Director for the Sixth Region (Pittsburgh, Pennsylvania) entered into a "STIPULATION FOR CONSENT ELECTIONS AND CERTIFICATION BY NATIONAL LABOR RELATIONS BOARD " Pursuant to the stipulation separate elections by secret ballot were cdliductdd on May 12, 1942, under the direction and supervision of the Regional Director among all employees at the following plants of the Company Y1'ori aiice Works, Torrance, California Pittsburg Works, Pittsburg, California Ironton Works, Ironton, Utah, except salaried employees, foremen, assistant foremen, supervisors in charge of any classes of labor, or watchmen, guards, confidential cler- 42NLRB,No202 - 1125 1126 DECISIONS OF NATIONAL LABOR RELATIONS BOARD ical employees regardless of method,of compensation (but not exclud- ing other cleiical employees on an hourly wage-rate 'basis), to deter- mine whether or not they desned to be represented by the Union. A question affecting commerce has arisen concerning the repre- sentation of employees of Columbia Steel Company , San Francisco, California , within the meaning of Section 9 (c) and Section '2 (6) and (7 ) of the National Labor Relations Act. 2 All employees at the following plants of the Columbia Steel Company Torrance Works, Torrance , California Pittsburg Works, Pittsburg , California Ironton Works , Ironton, Utah, except salaried employees , foremen, assistant foremen, supervisors in charge of any classes of labor, or watchmen, guards , confidential clerical employees regardless of method of compensation (but not excluding other clerical employees on an hourly wage-rate basis), constitute a unit appropriate for the purposes of collective bargain- ing within the meaning of Section 9 (b) of the Act' 3 United Steelworkers of America has been designated and selected by a majority of employees in the above-unit as their repre- sentative for the purposes of collective bargaining and is the ex- clusive representative of all employees in said unit within the meaning of Section 9 (a) of the Act CERTIFICATION OF 1 ,EPRESENTATIVES By, virtue of and pursuant to the power vested in the National Labor Relations Board by Section 9 (c) of the National Labor Relations Act, IT IS HEREBY CERTIFIED that Ui ited Steelworkers of America has been designated and selected by a majority of all the employees at the following plants of the Columbia Steel Company- Torrance Works, Torrance, California Pittsburg Works, Pittsburg, California Ironton Works, Ironton, Utah, ' The parties stipulated that the Board may in its Decision and Certification determine that those plants in which the Union receives a majority of the valid ballots cast shall comprise a single appropriate unit and that the Board may certify the Union as the exclusive collective bargaining iepcesentative for said single appropriate unit 1128 DECISIONS OF' NATIONAL LABOR RELATIONS BOARD, except salaried employees , foremen, assistant foremen, supervisors in charge of any classes of labor, or watchmen, guards, confidential clerical employees regardless of method of compensation (but not excluding other clerical employees on an hourly wage-rate basis), as their representative for the purposes of collective bargaining and that , pursuant to Section 9 (a) of the Act,, United Steelworkers of America is the exclusive representative of all such employees for the purposes of collective bargaining with respect to rates of pay, wages,-hours-of employment , and other conditions of 'employ- ment.
