R-1083 to R 1089, inclusive, respectively CERTIFICATION OF REPRESENTATIVES September 13, 1939 On July 22, 1939 , the National Labor Relations Board, herein called the Board , issued a Decision , Certification of Representatives, and Direction of Elections in the above-entitled proceeding? The Direc- tion of Elections provided that elections by secret ballot be conducted within twenty (20) days from the date of the Direction among all 1 The petition and amended petition in this case refer to United Artists Studio Corpora- tion . Subsequent to the hearing, counsel for Samuel Goldwyn Studios and counsel for the National Labor Relations Board stipulated in writing that on May 15, 1939, United Artists Studio Corporation changed its name to ' Samuel Goldwyn Studios ; that "in all actions taken and orders issued by the National Labor Relations Board subsequent to the date of this Stipulation , the 'party to the above investigation formerly known as 'United Artists Studio Corporation ' shall be known and designated as 'Samuel Goldwyn Studios"'; and that "in all actions taken and orders issued by the National Labor Relations Board in the' above matter between May 15, 1939, and the date of this Stipulation, whenever designa- tion 'United Artists Studio Corporation ' was used, it shall be understood that reference was had to 'Samuel Goldwyn Studios."' 213 N. Pictures, Inc., and United Artists Studio Corporation, respec- tively, as supervisory or chief art directors, unit art directors, and follow-up men, during the pay-roll period next preceding the date of issuance of the Direction of Elections, excluding those persons who had since quit or been discharged for cause, but including those per-' sons who did not work during such pay-roll period because. they were ill or on vacation, and persons who were then or had since been temporarily laid off, to determine whether or not such employees desire, in the case of each Company, to be represented by The Society of Motion Picture Art Directors for the purposes of collective bargaining. Pursuant to the Direction, elections by secret ballot were conducted on August 9, 1939, among the above-described employees of Samuel Goldwyn Studios, and on August 10, 1939, among such employees of Universal Pictures Company, Inc., and Warner Bros. Pictures, Inc., under the direction and supervision of the Acting Regional Director for the Twenty-first Region (Los Angeles, California). On August 15, 1938, the Acting Regional Director, acting pursuant to Article III, Section 9, of National Labor Relations Board Rules and Regula- tions-Series 2, issued and duly served upon the parties her Election Report. No objection or exceptions have been filed by any of the parties. As to the elections and their results, the Acting Regional Director reported as follows : UNIVERSAL PICTURES COMPANY, INC. Pictures, Inc., and Samuel Goldwyn Studios, respectively, as their representa- tive for the purposes of collective bargaining, and that, pursuant to Section 9 (a) of the Act, The Society of Motion Picture Art Directors is the exclusive representative, in the case of each Company, of all such employees for the purposes of collective bargaining in respect to rates of pay, wages, hours of employment, and other conditions of employment.
