JUDGMENT – REQUEST FOR ADVERSE 37 C.F.R. §41.127(b) Interference No. 106,038 2 On December 4, 2015, Junior Party Refractor Applications, LLC 1 (“Refractor”) informed the Board that Refractor does not wish to proceed with the 2 interference and wish to abandon the contest with respect to Count 1 set forth in 3 the Declaration of Interference entered on October 29, 2015. Paper 13. 4 Under 37 C.F.R. §41.127(b)(4), an abandonment of the contest is construed 5 to be a Request for Adverse Judgment. Refractor’s Request for Adverse Judgment 6 is GRANTED. 7 Accordingly, it is: 8 ORDERED that judgment on priority as to Count 1, the sole count of 9 the interference (Paper 1 at 4–5) be entered against Junior Party Refractor; 10 FURTHER ORDERED that Claims 1–19 of Junior Party Refractor’s 11 involved patent, US Patent No. 8,290,425 B2, which correspond to Count 1 of the 12 interference (Paper 1 at 4–5), are CANCELLED, 35 U.S.C. §135(a); 1 13 FURTHER ORDERED that a copy of this judgment shall be 14 entered into the administrative record of (1) Junior Party Refractor’s involved 15 patent, US Patent No. 8,290,425 B2 and (2) Senior Party Colby’s application, 16 US Application No. 12/978,868; and 17 FURTHER ORDERED that if there is any settlement agreement or 18 related documents which have not been filed, attention is directed to 35 U.S.C. 19 §135(c) and 37 C.F.R. §41.205. 20 1 “Patent interferences continue under the relevant statutes in effect on 15 March 2013.
