ORDER
The Respondent’s Motion to Strike Michael Schmidt’s Exceptions to the Decision
and Recommended Order of the Administrative Law Judge and Michael Schmidt’s
Response to Respondent’s Exceptions is granted in part. The Motion is granted
regarding the two pages of text messages attached to Mr. Schmidt’s Exceptions
because they are not part of the record and are not among the exhibits accepted at the
hearing. To the extent that Respondent’s Motion seeks to strike the remainder of Mr.
Schmidt’s Exceptions, it is denied. Respondent also moves to strike Mr. Schmidt’s
Response to Respondent’s Exceptions because the Response is a duplicate of Mr.
Schmidt’s Exceptions and does not address the issues raised in the Respondent’s
Exceptions as required by Section 102.46(d)(2) of the Board’s Rules and Regulations.
That part of the Motion is denied regarding the second paragraph of Mr. Schmidt’s
Argument section related to credibility, which addresses Respondent’s Exception 10.
The Motion to Strike the Response is granted in all other respects. By direction of the
