Case No. R-1146 SUPPLEMENTAL DECISION AND ORDER May 18, 1939 On March 10, 1939, the National Labor Relations Board, herein called the Board, issued a Decision, Order, and Direction of Election in the above-entitled case., The Direction of Election directed that an election by secret ballot be conducted within thirty (30) days from the date of the Direction among the employees of Central Ohio Steel Products Company, at its Galion, Ohio, plant, herein called the Company, whose names appeared on the Company's pay roll for the period August 16 to August 31, 1938, inclusive, excluding sales- men, draftsmen, supervisory and clerical employees, and specifically excluding Ezra Stroup, Ralph Hitsman, Paul Jewell, W. L. Poland, Clifford Young, R. Stall, and Cleo Armstrong, and those who had since quit or had been discharged for cause, but specifically including Frank Auker, B. H. Clark, and Russell C. Sipes, to determine whether or not they desire to be represented by International Association of Machinists, Lodge No. 1151 (A. F. of L.), for the purposes of collective bargaining. Pursuant to the Direction, an election by secret ballot was held on March 22, 1939, at Galion, Ohio, under the direction and supervision of James P. Miller, the Regional Director for the Eighth Region (Cleveland, Ohio). On March 23, 1939, the said Regional Director, acting pursuant to Article III, Section 9, of National Labor Re- lations Board Rules and Regulations-Series 1, as amended, issued and duly served upon the parties his Intermediate Report on the election. 111 N. F. of L.) ------------------- 52 Total number of votes against the International Association of Machinists , Lodge No. 1151 (A. F. of L.) ------------------- 63 Total number of blank bal lots_______________________________ 0 Total number of void ballots________________________________ 0 Total number of challenged ballots___________________________ 2 On March 30, 1939, the Union filed an objection to the election 2 ,on the ground that "just before the election the Company started a story among its employees if we won they would close the plant." The Regional Director has investigated this allegation and has re- ported that no proof has been adduced to support it. The objection is hereby overruled. The results of the election show that no collective bargaining rep- resentative has been selected by a majority of the employees. The petition for investigation and certification of representatives will, therefore, be dismissed. By virtue of Section 9 (c) of the National Labor Relations Act, 49 Stat. 449, and pursuant to Article III, Sections 8 and 9, of Na- tional Labor Relations Board Rules and Regulations-Series 1, as amended, it is hereby ordered that the petition for investigation and certification of representatives of the employees of Central Ohio Steel Products Company, be, and it hereby is, dismissed. 2 The objection was made in a telegram . to the Board dated March 29, 1939 Copy with citationCopy as parenthetical citation
